Return & Refund Policy

Gazebo Homes Ltd are committed to conducting real estate transactions with transparency, fairness, and professionalism. This Return and Refund Policy has been developed in accordance with Kenyan real estate practices, standard developer–buyer agreements, and applicable laws of the Republic of Kenya.

The purpose of this policy is to clearly explain how payments made toward property purchases are handled, the circumstances under which refunds may apply, and the procedures involved in cancellations, transfers, or payment adjustments.

Because real estate transactions involve long-term development planning, construction costs, legal documentation, and regulatory approvals, refunds cannot be treated in the same manner as ordinary consumer purchases.

1. Scope of This Policy

This policy applies to all payments made to Gazebo Homes Ltd, including:

  • Booking and reservation fees
  • Deposits toward property purchases
  • Installment payments under structured payment plans
  • Payments made for off-plan developments
  • Administrative and documentation-related fees

This policy must be read together with the following legally binding documents:

  • Letter of Offer
  • Sale Agreement
  • Payment Schedule
  • Project-specific addendums

In the event of any inconsistency, the signed Sale Agreement shall take precedence.

2. Nature of Real Estate Transactions in Kenya

Under Kenyan real estate practice:

  • Property transactions are contractual in nature
  • Payments are allocated toward land acquisition, statutory approvals, construction, financing, and operational costs
  • Developers rely on scheduled payments to meet project milestones

For this reason, most payments made in property transactions are non-refundable unless expressly stated otherwise in writing.

3. Booking and Reservation Fees

3.1 Purpose of Booking Fees

A booking or reservation fee is paid to:

  • Temporarily secure a specific housing unit
  • Remove the unit from active marketing
  • Initiate documentation and allocation processes

3.2 Refund Status

Booking fees are generally non-refundable.

However, a refund may be considered under limited circumstances, including:

  • The reserved unit becomes unavailable due to an internal administrative error
  • Gazebo Homes Ltd withdraws the unit or project before execution of the Sale Agreement

Where approved, refunds will be processed within 14–30 working days, subject to verification.

4. Deposit Payments

4.1 Definition

A deposit forms part of the total purchase price and is typically payable upon acceptance of the Letter of Offer or execution of the Sale Agreement.

4.2 Refundability

In line with standard Kenyan developer–buyer agreements:

  • Deposits become non-refundable once the Sale Agreement is signed
  • Deposits contribute toward construction mobilisation, approvals, and contractual obligations

Refunds may only be considered where:

  • Gazebo Homes Ltd materially fails to perform contractual obligations
  • A mutual written termination agreement is executed by both parties

5. Installment Payments

Installment payments made under flexible or structured payment plans:

  • Are non-refundable once paid
  • Are allocated toward ongoing construction, financing, and development expenses

Installment payments remain binding even if:

  • Construction is ongoing
  • The buyer experiences financial challenges
  • Market conditions change

6. Buyer-Initiated Cancellations

If a buyer elects to terminate or cancel the purchase:

  • The request must be submitted in writing
  • Eligibility for any refund depends strictly on the Sale Agreement
  • Administrative, legal, marketing, and financing costs may be deducted

Gazebo Homes Ltd reserves the right to:

  • Retain paid amounts as liquidated damages
  • Reallocate the unit for resale
  • Apply penalties as provided under contract

Each cancellation is reviewed on a case-by-case basis.

7. Developer-Initiated Cancellations

In rare circumstances where Gazebo Homes Ltd is unable to proceed with a project due to regulatory, legal, or unforeseen circumstances:

  • Buyers shall be notified in writing
  • Eligible payments shall be refunded in accordance with contractual terms
  • Refund timelines typically range between 30–60 working days

8. Transfers and Substitutions

In lieu of refunds, Gazebo Homes Ltd may, at its discretion, offer:

  • Transfer of payments to another available unit
  • Substitution into another Gazebo Homes development
  • Unit upgrades or downgrades (subject to price differences)

Such options are subject to:

  • Unit availability
  • Administrative fees
  • Written approval

9. Non-Refundable Charges

Approved refunds may exclude:

  • Legal documentation fees
  • Stamp duty already paid to government authorities
  • Bank transfer and transaction charges
  • Marketing and agent commissions
  • Administrative processing fees

10. Refund Processing Procedure

To request a refund, buyers must submit:

  • A written refund request
  • Proof of payment
  • Identification documents
  • Copies of signed agreements

Refunds are processed via:

  • Original payment method where possible
  • Bank transfer to the buyer’s nominated account

11. Data Protection & Confidentiality

All personal data submitted during refund processing is handled in compliance with the Kenya Data Protection Act, 2019.

Buyer information is used solely for:

  • Identity verification
  • Financial reconciliation
  • Legal compliance

12. Policy Amendments

Gazebo Homes Ltd reserves the right to amend this policy at any time. Updated versions shall be published on our official website and take effect immediately.
